1. Introduction
Welcome to the website of Jack Rosam (“I”, “me”, or “my”). By accessing or using this website, you agree to the following terms and conditions. Please read them carefully before browsing or making an inquiry.
2. Services
I offer professional photography and videography services. Each project is subject to a written agreement or booking confirmation that defines the specific scope, pricing, deliverables, and usage rights. These terms apply generally and may be supplemented or modified by any project-specific agreement.
3. Copyright & Usage
All images, videos, and related materials on this website are the intellectual property of Jack Rosam and are protected by copyright law under the Copyright, Designs and Patents Act 1988.
You may not copy, reproduce, or distribute any content from this website without prior written permission.
Upon full payment, you receive a non-exclusive, non-transferable licence to use the final delivered materials for the agreed purpose (e.g. personal, commercial, or editorial). This licence does not transfer ownership of the copyright.
I retain full moral rights in all work, including the right to be credited where reasonable. For editorial or public-facing use, I may request appropriate attribution.
Raw or unedited files are not included in any deliverable unless expressly agreed in writing.
I reserve the right to use any work produced for portfolio, promotional, and marketing purposes unless you request otherwise in writing prior to the shoot.
4. Bookings & Payment
A booking is confirmed once a deposit or signed written agreement has been received.
Deposits are non-refundable, as they secure your session date and my availability.
The remaining balance is due according to the schedule set out in your booking confirmation. Final deliverables will not be released until payment has been received in full.
Late payments may result in delays to delivery. Invoices outstanding beyond 14 days may incur a late payment charge in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
All prices are quoted in GBP. VAT will be applied where applicable.
5. Cancellations & Rescheduling
If you need to cancel or reschedule, please contact me as soon as possible. The following charges apply:
Cancellations made more than 14 days before the scheduled date: deposit retained, no further charge.
Cancellations made between 7 and 14 days before the scheduled date: 50% of the total fee is due.
Cancellations made less than 7 days before the scheduled date: 100% of the total fee is due.
If I need to cancel due to circumstances beyond my reasonable control (including but not limited to illness, injury, equipment failure, or extreme weather), I will make every effort to offer an alternative date. If no suitable date can be agreed, a full refund of any deposit paid will be issued. I shall not be liable for any additional losses arising from such cancellation.
6. Delivery & Editing
Final images and videos are delivered digitally within the timeframe agreed at the point of booking.
Delivery of final materials is conditional upon receipt of full payment.
Two rounds of revisions are included per day of editing, unless otherwise specified. Additional retouching or edit requests beyond this scope may be subject to additional fees, which will be agreed in advance.
Turnaround times are estimates and may be affected by project complexity or factors outside my control. I will notify you promptly of any anticipated delays.
7. Release & Third-Party Rights
It is your responsibility to obtain any necessary permissions, consents, or releases from third parties prior to the shoot, unless agreed otherwise. This includes, but is not limited to, permissions from individuals who appear on camera, owners of private locations, and rights-holders of any branded or copyrighted material that appears in the work. I accept no liability arising from the absence of such releases.
8. Privacy
All personal information shared through this website or during the booking process is handled in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your data will not be shared with third parties without your consent, except where required by law. For full details, please refer to my Privacy Policy.
9. Limitation of Liability
While every effort is made to ensure a professional and high-quality service, my total liability to you arising out of or in connection with any booking or use of this website shall not exceed the total fees paid by you for the relevant project. I am not liable for any indirect, consequential, or special losses, including but not limited to loss of profit, loss of opportunity, or loss of data.
Nothing in these terms affects any statutory rights you may have as a consumer under applicable law. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the law of Scotland. Any disputes arising under these terms shall be subject to the jurisdiction of the Scottish courts.
11. Changes to Terms
These terms may be updated periodically. The latest version will always be available on this website, and the date of last revision will be clearly displayed.
